MUHAMMED ŞEYBÂNÎ’NİN MUVATTA’DA KULLANDIĞI FIKHİ TERİMLER

Özet

İslam Hukukunun nesiller boyu doğru anlaşılabilmesinin en önemli yollarından biride sistemli ve anlaşılabilir eserler ortaya konulmasıdır. Bunun için kullanılan terimler ve bu terimlere yüklenen anlamlar önem arz etmektedir. Ancak fıkhın sistemleşmesiyle ve mezheplerin oluşmasıyla birlikte terimlere yüklenen anlamlarda farklılıklar ortaya çıkmıştır. Kadim fıkhi eserleri doğru anlamak ve doğru bir şekilde aktarabilmek için müellifin kullandığı terimleri de doğru anlamalıyız. Nitekim Hanefi mezhebinin teşekkülünde önemli bir yeri olan İmam Muhammed'in yazdığı eserlerde de fıkhi terimler bulunmaktadır. İmam Malik'ten rivayeten almış olduğu hadisleri aktarırken bazı fıkhi terimler kullanmış ve bu fıkhi terimler sonraki dönemde usulün de sistemleşmesiyle farklı anlamlar kazanmışlardır. Fakihler aynı terime mensubu olduğu mezhep çerçevesinde farklı anlamlar yüklemişlerdir. Çalışmamızda İmam Muhammed'in, Muvatta'ın rivayetinde kullandığı terimlerden bir kısmını inceleyerek ilk dönem ile sonraki dönem fıkıh kitaplarındaki terimlere yüklenen anlam farklılığı ortaya koyulmaya çalışılmıştır.

Abstract

One of the most important ways of understanding Islamic Law correctly for generations is to produce systematic and understandable works. For this, the terms used and the meanings attributed to these terms are important. However, with the systematization of fiqh and the formation of sects, differences have emerged in the meanings attributed to the terms. We must also understand the terms used by the author correctly in order to understand and convey the ancient fiqhi works correctly. As a matter of fact, there are fiqh terms in the works written by Imam Muhammad, who has an important place in the formation of the Hanafi sect. He used some fiqh terms while conveying the hadiths he received from Imam Malik, and these fiqh terms gained different meanings with the systematization of the method in the following period. Faqihs have attributed different meanings to the same term within the framework of the sect they belong to. In our study, by examining some of the terms used by Imam Muhammad in the narration of Muwatta, we tried to reveal the difference in meaning attributed to the terms in the fiqh books of the first and later periods.
