İSLAM'IN KOLAYLAŞTIRMA METODU HAKKINDA KRİTİK BİR ANALİZ ÇALIŞMASI

Özet

İslam hukukunun binası, kulların dünya ve ahiret maslahatlarını temin üzerine inşa edilmiştir. Onun tümü de adalet, rahmet ve hikmettir. Adaletten otoriterliğe, rahmetten zulme, maslahattan mefsedete, hikmetten cehalet ve ahmaklığa çıkan hiçbir meselenin İslam hukukuyla ilgisi yoktur. Ona yorum aracılığıyla sokulmuş olsa bile! İslam hukukunun en büyük gayesi, sıkıntı ve zorlukları gidermek, kolaylaştırıcı ilkeleri insanlara sunarak, insanlık için yaşanılabilir bir hayatı temin etmektir. Ancak insanların hem dünya hem de ahiret saadetlerini ilgilendiren maslahat ve mefsedetin takdir edilmesi/ölçümlenmesi kolay bir iş değildir. Bilakis son derece hassasiyet gerektiren bir sorumluluktur. Çünkü maslahat da mefsedet de İslam Şeriatının naslarıyla ve prensipleriyle disipline edilmiştir. Bu nedenle onların takdir edilmesini, ancak Kur'an ve Sünnet naslarını iyi bilen ve şeriatın/İslam hukukunun amaçlarını en ince detaylarıyla kavrayan ilim ehli bilebilir.

Abstract

The building of Islamic law was built to ensure the benefits of the servants in the world and in the hereafter. All of it is justice, mercy, and wisdom. Any issue that slides from justice to authoritarianism, from mercy to oppression, from benefits to harm, from wisdom to ignorance and stupidity has nothing to do with Islamic law. Even if it was lured through the comments to it? The greatest aim of Islamic law is to eliminate the troubles and difficulties and to provide a livable life for humanity by presenting the facilitating principles to the people. However, it is not an easy task to appreciate/measure the interests and convictions that concern people's happiness both in the world and in the hereafter. On the contrary, it is a responsibility that requires utmost precision. Because both benefits and drawbacks are disciplined with the teachings and principles of the Islamic ruling (Shari'ah). For this reason, only those who know the Qur'an and Sunnah and understand the aims of Shari'ah/Islamic law to the finest detail can know their appreciation.
