أثرُ تغيُّرِ قيمة العملةِ الورقيةِ في الدَّيْنِ

Özet

الأصل في هذه المسألة أن الواجب على الدائن رد المثل ولا عبرة بالرخص والغلاء، وهو قول جمهور الفقهاء، وعليه قرار مجمع الفقه الإسلامي، وقال أبو يوسف من الحنفية بأن الواجب هو أداء القيمة في الرخص والغلاء، وهناك قول يجمع بين القولين الأوليّين، أخذ به بعض المتقدمين، وهو بأن الواجب رد المثل إذا كان التغير قليلاً، وأما إذا تفاحش وبلغ مبلغ سقوط الانتفاع وجبت القيمة، والحل الأمثل في هذه المسألة هو ربط عقود المداينات بسعر صرف الذهب، وبذلك يتم التخلص من مشاكل تغيير قيمة العملة والله أعلم.

Abstract

The origin in this matter is that the creditor must repay the exact debt, and it is not a matter of cheapness or the high price, which is the view of the majority of Fuqaha' and the view of the Islamic Fiqh Academy, Abu Youssef from the Hanafi School said that money amount must be repaid in cheapness and expensiveness, but there is another say combines the both and it was accepted by some modern scholars and it says that the creditor must repay the debt if the change is insignificant but if the change became huge and the amount of money lost its cash value then the repay must be with the true value of the debt, and the best solution for this matter is connecting the debts contracts with the value of the gold to get rid of the problems related to changes in currency value and Allah only know.
