MANA İLE RİVAYETİN FIKHİ HÜKÜMLERİN İHTİLAFINDA ROLÜ

Özet

Rivayetlerin metin itibarıyla senet ve lafızların yanında o lafızların delalet ettiği manadan ibaret olduğu herkesçe aşikârdır. Ancak lafızlar olduğu gibi muhafaza edilemediği durumlarda mana ile rivayet yoluna başvurulabilir mi? bu konuda bir takım ihtilaflar mevcuttur. Bu nedenle Sahabe döneminden bil itibar mana ile rivayet noktasında bir takım farklı görüşlere yer verildiği görülmektedir. Mana ile rivayete mutlak manada cevaz verenler, ya da asla caiz görmeyenler olduğu gibi bir takım şartlar dâhilinde cevaz verenler de olmuştur. Hem bu farklı görüşleri delilleriyle beraber izah etmeye çalıştığımız bu makalenin asıl kaleme alınışının sebebi mana ile rivayetin fıkhi hükümlere etkisinin ne olduğudur. Bununla alakalı bir örnekle de olsa izaha çalıştığımız bu çalışmada mana ile rivayetin fıkhi hükmün ihtilafına ciddi manada etki ettiğini söylemek mümkündür. Zira özellikle fıkhi mezhep âlimleri bir konu hakkındaki görüşlerini dayandırmak için kullandıkları deliller aynı konuyla alakalı ancak farklı lafızlarla gelen metinler olunca hüküm itibarıyla da aralarında bir takım farklılıklar olması kaçınılmaz olmuştur.

Abstract

It is clear to everyone that the narrations consist of the deed and the wording as well as the meaning implied by those words. However, in cases where the words cannot be preserved as they are, is it possible to resort to narration with meaning? There are some disputes about this. For this reason, it is seen that there are some different views on the point of narration from the period of the Companions. There are those who give absolute permissiveness to the meaning and narration, or those who never see it as permissible, and there are also those who allow it under certain conditions. Besides, the main reason for the writing of this article, which we try to explain these different views with their evidence, is the effect of the meaning and the narration on the jurisprudence. It is possible to say that in this study, which we tried to explain, even with a related example, it has a serious impact on the conflict between the meaning and the narration. Because, especially when the evidences used by the scholars of fiqh sects to base their opinions on a subject were texts related to the same subject but with different words, it was inevitable that there would be some differences between them in terms of provisions.
